Jen
Columbia, MO
Jen, thank you so much for asking. If you listed a .08 or greater in a blood alcohol test or breath test, you shall lose your right to drive in Columbia, and the within the whole state of Missouri for 30 days. Usually you are qualified for an opportunity to handle a vehicle after 10 days if you fulfill with statutory procedure.
There are times that you can be exempted from appearing at court dates. The Court may hold back some or all of the proof against you if your constitutional rights have been defied. Your attorney may file motions to hold back. It happens from 4 weeks to 2 years after you are accused.
Then there is a hearing to a judge sitting as judge and jury. If you have been found guilty, you can request and ask for a jury of twelve to listen to your case. They will not be informed of the first verdict. The Court will then inflict a sentence after a guilty verdict at trial or after a plea agreement is accepted and a plea goes in. Your punishment will be including jail time, in home detention, public service, alcohol classes, community service, license suspension, supervised probation and fines.
